Panda Carrier Pty Ltd as Trustee for DJE Trust owns and operates this website, found under www.pandacarrier.com.au, www.panda-carrier.com.au, www.pandacarrier.com, www.panda-carrier.com. PANDA CARRIER PTY LTD ACN 648 284 048 as Trustee for DJE Trust 84 127 392 428 uses the terms “us”, “our” or “we” on this Website. We provide information about the Product and services via this site to Customer uses the terms you, your conditioned upon your acknowledgement that you have read, understood and agreed to be bound by these Terms and Conditions stated here. If you do not agree to the Terms and Conditions, please do not access this Website or use our services.

Any new features or products which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Trial period

Customers, who made their purchase online have a 30-days long trial period when you can return the Panda Child Carrier to us. The trial starts on the day you receive the carrier.

If you decide to return the carrier, please contact us to arrange the return postage which will be on us. We pay only for the postage organised by us, so if you decide to send it on your own, we won't refund the freight costs.

There are just a few conditions:

  • the goods are returned within 30 days starting on the day of delivery
  • the goods are in original conditions and packaging, clean with all accessories and labels
  • the goods are not damaged
  • the goods are returned together with any free or bonus items that were provided at the time of purchase
  • The service is not available to customers who already use the trial period in the past (it also applies to different colours).

Dispatching your order

Provided your items are in-stock, and payment has been received we will dispatch your order from our warehouse within two (2) business days. Products will generally arrive within five to ten (5-10) business days to metropolitan regions depending on Product availability. If an item is out of stock, it can be purchased on pre-order. If all ordered Products are in-stock, we will NOT delay dispatch to a later date. The order will be dispatched within two (2) business days. If Products in an order are a combination of in-stock and pre-order items and depending on the items in the order, all Products in the order will be dispatched when all Products in the order are back in stock.

If Products are to be delivered to a Customer, any period or date for Delivery stated by us is intended as an estimate only and is not a contractual commitment.  We will use its best endeavours to meet any estimated Delivery dates, but we will not be liable for any loss or damage suffered by the Customer or any other person for failure to meet an estimated Delivery date. We reserve the right to amend Delivery methods without notice.

We suggest Customers request Delivery to an address where the Delivery can be signed for during business hours. Our shipping costs will only cover one (1) Delivery attempt; it’s the Customer responsibility to provide a Delivery address that will be attended at the time of Delivery. The Customer is responsible for paying all additional Delivery costs as charged by the Delivery company to us before receiving addition Delivery attempts.

Pre-order Terms and Conditions

You will be charged at the time of placing a Pre-Order. Any period or date for Delivery stated by us is intended as an estimate only and is not a contractual commitment. If we are unable to commence shipping of a Pre-Order Product within 14 days of the expected ship date, we will offer a full refund to you. 

All Pre-Orders are handled through the Shopify Payment platform. Methods of payment accepted are Visa, Master Card, AfterPay, PayPal and others as made available from time to time by the payment gateway provider. Your placing of a Pre-Order constitutes your express agreement for us to charge your provided payment method at the time of placing the pre-order. 

You are responsible for keeping your shipping and contact information up-to-date to ensure proper shipment of any Pre-Order Products. Please email info@pandacarrier.com.au to advise of any changes.

Warranty

Our goods come with guarantees under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

The Products are covered against faults in material and workmanship when used under normal conditions, according to user manuals and technical specifications, for 12 months from the date of dispatch of the Product from us to the customer.

If a Customer discovers a fault in a Product’s material or workmanship, and we inspect the Product and confirm that it is a fault, then we will replace the Product or faulty part of the Product, or repair the fault if notified within the 12 month Warranty period.

To issue a Warranty claim, the Customer will be required to:

1. Contact us to identify the defect in the product and discuss further actions. If advised by us, a customer is asked to follow Returning goods section.

2.  Customers are liable for transportation costs

3. To the extent permitted by law, the following are not covered by Warranty:

(i) failure or defects resulting from improper care or use;

(ii) normal wear and tear including scratches to the frame;

(viii) corrosion or rust due to extreme environmental conditions, including high humidity, salt spray, ice or snow or due to insufficient maintenance;

(ix) accidental or intentional damage, abuse or neglect;

(x) damage to the handle bar grips or fabrics as a result of normal handling and daily use;

(xi) airline/transport damage: check your Product carefully after it has been handled by the airline (or other transporters) and if required, submit your claim directly to your travel insurer/ airline;

(xii) consumer dissatisfaction with the Product in terms of disliking the fit, weight, functionality, colour or style;

Warranties do not apply where the Products are acquired for rental, hire or other commercial purposes.

Returning goods

If wishing to return a purchased item, please contact us so we will be able to arrange transport and inform you of any further details required.

We generally pay only for freight arranged by us, unless agreed otherwise. Return of any goods to us is subject to the following conditions:

  • Items are in an original conditions, clean, with all accessories and labels.
  • Items are returned together with any free or bonus items that were provided with the item at the time of purchase.
  • Items are well wrapped and send to the address provided, preferably in the original packaging.

Cancelling an order

We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

  • the Products in that order are not available;
  • there is an error in the price or the Product description posted on the Website for the Product in that order;
  • We deem a coupon code has been applied to an order in an unauthorised or incorrect manner, which will be at the sole and unfettered discretion of us;
  • The order was paid for via direct deposit, and the Products in that order sold out while we were awaiting the funds to be received for that order; or
  • Your order has been placed in breach of these Terms and Conditions.

The material on this website is protected by copyright under the laws of Australia and may not be used without our written permission. You may not, in any form or by any means: (a) copy, adapt, reproduce, store, distribute, print, display, perform, publish, communicate to the public, make available to public or create derivative works of the whole or any part of the materials; or (b) commercialise the whole or any part of the materials, without our express written permission or, in the case of third party material, from the owner of the copyright in that material.

The Intellectual Property Rights of whatever nature, and wherever in the world, in the Products are and shall remain our property.

The Customer shall notify us immediately if it becomes aware of any illegal or unauthorised use of the whole or any part of the Products or the Intellectual Property in them, including any infringement of Trademarks or suspicion of the occurrence of fake products

Accuracy, completeness and timeliness of information

We are not responsible if information made available on this website is not accurate, complete or current. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

In any case of a claim for liability, we may ask the Customer to provide evidence about the title to the Product by invoice or another relevant document and prove.

We shall under no circumstances be liable to the Customer for purely economic losses, loss of profits, loss of contracts, loss of opportunity, loss of business, loss or depletion of goodwill, increased overheads or administration expenses, management time, loss of savings, loss of data, or any type of special, indirect or consequential loss of any nature whatsoever (including without limitation loss or damage suffered by the Customer as a result of an action brought by any third party) even if such loss was reasonably foreseeable or Panda Carrier Pty Ltd had been advised of the possibility of the Customer incurring it.

Jurisdiction

This agreement is governed by the laws of South Australia, Australia. Each party submits to the non-exclusive jurisdiction of the courts of that place. Any rights or remedies to which you are entitled under the Australian Consumer Law arise independently of these Terms and Conditions, and this clause does not apply to any claim you may have under the Australian Consumer Law.
